Terms of Use
Please read these terms carefully before using ScamVerify™. By accessing or using our Service, you agree to be bound by these Terms.
1. Description of Service
ScamVerify™ LLC ("ScamVerify," "we," "us," or "our") operates the ScamVerify.ai website and related services (the "Service"). ScamVerify™ is an AI-powered personal threat-intelligence service built around Ava, your AI security analyst. The Service includes:
- AI security analyst (Ava) - a conversational analyst that investigates suspected scams across seven channels (phone numbers, websites, text messages, emails, voicemails, documents, and QR codes), explains the risk in plain English, and recalls useful context across your conversations
- Multi-source threat analysis - carrier and line-type forensics, FTC/FCC complaint cross-referencing, robocall and threat-intelligence checks, and vision-AI document analysis, synthesized into a single risk assessment
- Protective actions - with your confirmation, Ava can act on your behalf, such as blocking or reporting a number, managing your watchlist, and (when you opt in) reporting fraud to the FTC (Section 5.3)
- Email forwarding analysis - forward a suspicious email to scan@scamverify.ai for an AI-powered analysis delivered back to you
- Community reports - user-submitted reports about phone numbers and other threats
- Family and multi-seat protection - on Duo and Family plans, consent-based protection for the people you choose (Section 4.8)
Additional channels and capabilities may be added over time.
2. Acceptance of Terms
By using ScamVerify™, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date above. Your continued use of the Service after any changes constitutes acceptance of those changes.
3. Account Registration and Authentication
3.1 Account Creation
You may create an account using your email address via passwordless email verification code authentication, or by signing in with Google OAuth. You must provide accurate information and keep your account credentials secure.
3.2 Account Security
You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use through our contact form.
3.3 Account Termination
You may delete your account at any time through Settings > Privacy & Data. Upon deletion, your account, watchlist, lookup history, and all associated data will be permanently removed. Active subscriptions must be canceled before account deletion. We reserve the right to terminate accounts that violate these Terms.
4. Subscriptions, Billing, and Cancellation
4.1 Free and Paid Tiers
ScamVerify™ offers both free and paid access:
- Free access: Free teaser previews for any visitor, with or without an account (partial results, no full AI analysis)
- Paid subscriptions: Individual ($15/month or $13/month billed annually), Duo ($25/month or $21/month billed annually), and Family ($37/month or $33/month billed annually) plans, each unlocking the full analyst across all channels. Plans differ by the number of people covered, not by a per-lookup quota.
Current pricing and plan details are available on our pricing page. We reserve the right to change pricing with at least 30 days advance notice to existing subscribers.
4.2 Automatic Renewal
AUTOMATIC RENEWAL NOTICE
Your subscription will automatically renew at the end of each billing period (monthly or annually) at the then-current price unless you cancel before the renewal date. You will be charged the applicable subscription fee to the payment method on file. You may cancel your subscription at any time through your account Settings.
4.3 Payment Processing
All payments are processed by Stripe, Inc. ("Stripe"). By subscribing, you agree to Stripe's Services Agreement. ScamVerify™ does not store your credit card numbers. You are responsible for keeping your payment information current.
4.4 Cancellation
You may cancel your subscription at any time online through Settings > Billing > Manage Subscription. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the end of the period you have already paid for. No partial refunds are provided for unused time within a billing period.
4.5 Refunds
Subscription fees are generally non-refundable. If you experience a material issue with the Service that we are unable to resolve within 10 business days of your written notice, you may cancel and receive a pro-rated refund for the unused portion of your current billing period. To request a refund, please contact us.
4.6 Usage and Fair Use
Every paid plan includes full access to the analyst across all channels, with no per-lookup quota. Plans differ only by the number of people covered. Reasonable fair-use limits apply to protect the Service from abuse; we will contact you before restricting any normal individual use.
4.7 Failed Payments
If a payment fails, we may retry the charge according to Stripe's retry schedule. If payment cannot be collected after multiple attempts, your subscription may be suspended or canceled. You will be notified by email of failed payment attempts.
4.8 Family and Multi-Seat Plans
Duo and Family plans let more than one person be protected under a single subscription. These plans are for adults only.
- Each member has their own private analyst and account. The person who pays for the plan (the "plan owner") manages billing but is not automatically able to act for, or see the activity of, any other member.
- Protective authority is directional and consent-based: a member may grant a specific other member's Ava permission to take help-only protective actions for them (such as blocking or reporting a number), and may separately allow that person to see the threat outcomes handled on their behalf. Each permission is granted by the protected member, is revocable at any time, and never extends to viewing that member's private activity or changing their account.
- Inviting someone to your plan, and accepting an invitation, are voluntary. A member may leave at any time.
5. Permitted and Prohibited Use
5.1 Permitted Use
You may use ScamVerify™ to:
- Investigate suspected scams across phone numbers, websites, text messages, emails, voicemails, documents, and QR codes with Ava
- Ask Ava follow-up questions and rely on her memory of your prior investigations
- Submit community reports about suspicious communications you have received
- View community reports and risk assessments
- Monitor phone numbers via your watchlist and receive notifications about changes
- Manage your account, family protection, and notification preferences conversationally or in Settings
5.2 Prohibited Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Submit false, misleading, or malicious reports
- Attempt to manipulate risk scores or community reports
- Use Ava to impersonate a person or to misrepresent that someone is communicating with a human
- Attempt to manipulate, jailbreak, or inject instructions into the analyst to bypass its safety rules
- Use the Service or its outputs to facilitate, plan, or carry out fraud, a scam, or other harm to others
- Use automated systems (bots, scrapers) to access the Service without written permission
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service to harass, stalk, or harm any individual
- Impersonate any person or entity
- Use information obtained from the Service to make harassing communications
- Share your account credentials with others
- Create multiple accounts to circumvent any limits or restrictions
- Reverse-engineer, decompile, or disassemble any part of the Service
5.3 Authorizing Ava to Act on Your Behalf
Ava can take certain actions for you, but only with your confirmation at the time of the action, and you remain responsible for any action you confirm.
- Confirm before acting: Ava asks you to confirm before any action that changes your account or contacts a third party.
- FTC reporting: If you ask Ava to report fraud to the FTC on your behalf, you authorize her to submit a report using only the facts you provide, together with your email address so the FTC can confirm it to you. You represent that the facts you provide are true. This feature is off by default; when it is unavailable, Ava gives you a prefilled summary to file yourself at reportfraud.ftc.gov.
- Family on-behalf-of actions are governed by Section 4.8.
6. Rate Limits and Usage Policies
To ensure fair access and prevent abuse, ScamVerify™ enforces usage limits including per-hour verification limits, daily report submission limits, and contact form rate limits. Specific limits are disclosed in the Service. Exceeding rate limits will result in temporary restrictions with clear error messages indicating when you can try again.
Repeated attempts to bypass limits may result in temporary IP bans (1 to 24 hours), extended bans for repeat offenses, permanent bans for severe abuse, or legal action for commercial scraping.
6.1 Commercial Use
The Service is for personal, non-commercial use unless you have written authorization for commercial use. Commercial use includes but is not limited to reselling data, integrating with other products, or systematic data collection. Contact us for commercial licensing inquiries.
7. AI-Generated Content and Disclaimers
IMPORTANT: AI ANALYSIS DISCLAIMER
ScamVerify™ uses artificial intelligence to generate risk scores, analysis narratives, and safety recommendations. Ava is an automated AI system, not a person. AI-generated content is provided for informational purposes only and should not be treated as legal, financial, or professional advice.
You acknowledge and agree that:
- AI-generated analysis may be inaccurate, incomplete, or outdated
- Risk scores are algorithmically generated and may not reflect the true nature of any phone number, website, text, email, document, or QR code
- A "safe" rating does not guarantee that a number or URL is legitimate, and a "high risk" rating does not confirm it is a scam
- You are solely responsible for verifying AI-generated outputs before acting on them
- AI analysis is not a substitute for professional advice from law enforcement, legal counsel, or financial advisors
- Results may vary between analyses of the same input due to the nature of AI systems
ScamVerify™ does not use your submitted data or your conversations with Ava to train AI models, and we do not sell your personal information. Your data is sent to our AI providers solely to generate your analysis results, under terms that prohibit training on it.
If an assessment about a phone number you own or represent appears wrong - for example because the number was reassigned to you or is being spoofed - you can ask us to review and correct it. See our dispute and correction process.
8. Community Reports and User Content
8.1 User Submissions
When you submit a community report, you represent that:
- The information you provide is truthful and accurate to the best of your knowledge
- You actually received the communication you are reporting
- You are not submitting reports to harass or defame any individual or business
8.2 License to Use
By submitting content to ScamVerify™, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, aggregate, and distribute your submissions as part of the Service. We may use anonymized and aggregated report data to improve scam detection.
8.3 No Verification
We do not independently verify user-submitted reports. Community reports reflect user opinions and experiences and are not endorsed by ScamVerify™. Reports are subject to our Community Guidelines and Moderation Policy.
9. Disclaimer of Warranties
IMPORTANT NOTICE
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We specifically disclaim:
- Accuracy: We do not guarantee that risk scores, AI analysis, carrier data, or community reports are accurate, complete, or current
- Reliability: We do not guarantee uninterrupted or error-free access to the Service
- Community Reports: User-submitted reports are not verified and may be inaccurate, outdated, or maliciously submitted
- AI Analysis: AI-generated content is informational only and should not be solely relied upon for making decisions
- Third-Party Data: Data from government databases (FTC, FCC) and third-party providers may contain errors or be incomplete
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCAMVERIFY™ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Financial losses resulting from reliance on our Service or AI-generated analysis
- Damages from falling victim to scams despite using our Service
- Loss of data or privacy breaches
- Damages from inaccurate information provided by the Service or third-party data sources
- Damages from actions taken based on community reports or risk scores
- Any other damages arising from your use of the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 USD OR (B) THE TOTAL AMOUNT PAID BY YOU TO SCAMVERIFY™ IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
11. Indemnification
You agree to indemnify, defend, and hold harmless ScamVerify™ LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service, including community reports
- Any decisions or actions you take based on AI-generated analysis or risk scores
12. Intellectual Property
All content on ScamVerify™, including but not limited to text, graphics, logos, software, data compilations, risk scoring algorithms, and AI-generated analyses, is the property of ScamVerify™ LLC or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
13. Third-Party Services
ScamVerify™ uses third-party services to operate the platform. By using the Service, you acknowledge that your data may be processed by these providers in accordance with their respective privacy policies:
- AI providers - generating Ava's analysis
- Payment processing - Stripe
- Carrier and telecom data - carrier, line type, and caller ID verification
- Identity and address verification - validating entities extracted from documents
- Threat intelligence - phone, domain, and malicious-URL reputation data
- Authentication and sign-in - including Google OAuth if you choose it
- Bot protection - Cloudflare Turnstile (a CAPTCHA alternative)
- Product analytics and error monitoring
- Transactional email delivery
We also access publicly available government databases including the FTC Do Not Call Registry and FCC Consumer Complaints, as well as industry threat intelligence databases. We are not responsible for the availability, accuracy, or content provided by third-party services or government databases.
13.1 Wireless Carrier Authorization
You authorize your wireless carrier to use or disclose information about your account and your wireless device, if available, to ScamVerify™ LLC or its service provider for the duration of your business relationship, solely to help them identify you or your wireless device and to prevent fraud. See our Privacy Policy for how we treat your data.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.
15. Copyright and DMCA
If you believe that content on ScamVerify™ infringes your copyright, please submit a DMCA takedown notice through our contact form with the subject "Legal Inquiry." Your notice must include: identification of the copyrighted work, identification of the infringing material with sufficient detail for us to locate it, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement under penalty of perjury that your notice is accurate.
16. Termination
We reserve the right to terminate or suspend your access to the Service at any time, without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination by us without cause, active paid subscribers will receive a pro-rated refund for the unused portion of their current billing period. Upon termination for cause (violation of these Terms), no refund will be provided.
17. Dispute Resolution
18.1 Informal Resolution
Before filing any formal dispute, you agree to attempt to resolve the matter informally by contacting us and allowing 30 days for resolution.
18.2 Binding Arbitration
If informal resolution fails, any dispute arising from these Terms or your use of the Service shall be resolved through binding arbitration in Los Angeles County, California, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall be conducted in California, and the arbitrator's authority is limited to disputes arising out of or relating to your use of, payment for, or provision of the Service.
18.3 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
18.4 Small Claims Court
Notwithstanding the above, either party may bring an individual action in small claims court in Los Angeles County, California, for disputes within the court's jurisdictional limits.
18.5 Opt-Out
You may opt out of the arbitration and class action waiver provisions by sending written notice to us through our contact form within 30 days of creating your account. If you opt out, disputes will be resolved in the state or federal courts of Los Angeles County, California.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. California residents are entitled to all protections provided by California consumer protection laws, including the California Automatic Renewal Law and the California Consumer Privacy Act (CCPA).
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
20. Entire Agreement
These Terms, together with the Privacy Policy, Community Guidelines, and Moderation Policy, constitute the entire agreement between you and ScamVerify™ LLC regarding your use of the Service and supersede all prior agreements and understandings.
