Welcome to ScamVerify.ai ("Service"), operated by Leonard D. Kim ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.
1. Description of Service
ScamVerify is a community-driven phone number verification platform that provides:
- Phone number lookup and carrier information
- AI-powered scam risk analysis
- Aggregated community reports about phone numbers
- Risk scores and safety recommendations
2. Acceptance of Terms
By using ScamVerify, you acknowledge that you have read, understood, and agree to be bound by these Terms. We reserve the right to modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of those changes.
3. Use of Service
3.1 Permitted Use
You may use ScamVerify to:
- Look up phone numbers to assess potential scam risk
- Submit reports about phone numbers you have received calls from
- View community reports and risk assessments
3.2 Prohibited Use
You agree NOT to:
- Use the Service for any illegal purpose or in violation of any laws
- Submit false, misleading, or malicious reports
- Attempt to manipulate risk scores or community reports
- Use automated systems (bots, scrapers) to access the Service without permission
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any portion of the Service
- Use the Service to harass, stalk, or harm any individual
- Impersonate any person or entity
- Use information obtained from the Service to make harassing phone calls
4. API & Usage Limits
To ensure fair access and prevent abuse, ScamVerify enforces the following usage limits:
4.1 Phone Number Verification
- Limit: 20 verifications per hour per user
- Applies to: All users
- Reset: Hourly rolling window
4.2 Report Submissions
- Limit: 5 reports per day (global)
- Limit: 3 reports per day per phone number
- Limit: 1 report per hour per phone number
- Applies to: All users
- Reset: Daily at midnight UTC
4.3 Contact Form
- Limit: 5 messages per hour
- Applies to: All users
- Reset: Hourly rolling window
4.4 Rate Limit Responses
When you exceed a rate limit:
- You will receive an error message
- The message will indicate when you can try again
- Repeated attempts to bypass limits may result in extended bans
4.5 Prohibited Automation
The following are strictly prohibited:
- Automated scripts or bots
- Scraping or bulk data collection
- API access without authorization
- Circumventing rate limits
- Creating multiple accounts to bypass limits
4.6 Consequences
Violations of usage limits may result in:
- Temporary IP bans (1-24 hours)
- Extended bans for repeat offenses
- Permanent bans for severe abuse
- Legal action for commercial scraping
4.7 Commercial Use
ScamVerify is for personal, non-commercial use only. Commercial use, including but not limited to reselling data, requires written authorization. Contact us for inquiries.
4.8 API Access
ScamVerify does not currently offer a public API. Unauthorized API access is prohibited and may result in legal action.
5. Disclaimer of Warranties
IMPORTANT NOTICE
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We specifically disclaim:
- Accuracy: We do not guarantee that risk scores, AI analysis, or community reports are accurate, complete, or current. Phone numbers flagged as "safe" may still be scams, and numbers flagged as "risky" may be legitimate.
- Reliability: We do not guarantee uninterrupted access to the Service.
- Community Reports: User-submitted reports are not verified and may be inaccurate, outdated, or maliciously submitted.
- AI Analysis: Our AI-powered analysis is experimental and should not be solely relied upon for making decisions.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEONARD D. KIM AND SCAMVERIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Financial losses resulting from reliance on our Service
- Damages from falling victim to scams despite using our Service
- Loss of data or privacy breaches
- Damages from inaccurate information provided by the Service
- Damages from actions taken based on community reports
- Any other damages arising from your use of the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 USD.
7. Indemnification
You agree to indemnify, defend, and hold harmless Leonard D. Kim, ScamVerify, and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your access to or use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit to the Service
8. Community Reports and User Content
8.1 User Submissions
When you submit a report about a phone number, you represent that:
- The information you provide is truthful and accurate to the best of your knowledge
- You actually received a call from the number you are reporting
- You are not submitting reports to harass or defame any individual or business
8.2 License to Use
By submitting content to ScamVerify, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, and distribute your submissions as part of the Service.
8.3 No Verification
We do not verify user-submitted reports. The accuracy and reliability of community reports are not guaranteed.
9. Intellectual Property
All content on ScamVerify, including but not limited to text, graphics, logos, and software, is the property of Leonard D. Kim or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
10. Third-Party Services
ScamVerify uses third-party services including Twilio (phone number verification) and Anthropic (AI analysis). Your use of the Service is also subject to the terms of these third-party providers. We are not responsible for the availability, accuracy, or content provided by third-party services.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
12. Termination
We reserve the right to terminate or suspend your access to the Service at any time, without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service will immediately cease.
13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Los Angeles County, California.
14. Dispute Resolution
Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in Los Angeles, California, in accordance with the rules of the American Arbitration Association.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and ScamVerify regarding your use of the Service and supersede all prior agreements and understandings.
